Alina Habba has resigned as the chief federal prosecutor in the state. This follows a judicial decision that questioned her legal standing to hold the office.

Attorney General's Statement

US Attorney General, the Attorney General, confirmed Habba's resignation on the start of the week. In a statement that the judicial decision made it "untenable" for the official to perform her duties.

"Let no one confuse compliance for surrender," Habba stated. "The effort will now extend throughout the nation."

Judicial Challenge

The departure comes a week after a federal appellate panel found that she had been unlawfully serving as the top prosecutor. This judgment is could influence numerous prosecutions in the Garden State.

The court declared that a temporary posting that skirted Senate approval breached the statute on vacant positions.

Bondi said that Habba will remain at the justice department as a top consultant. She will seek further review of the disqualification, aiming for a reversal.

Writing online, Bondi wrote that judges "must not countermand the executive's selection of attorneys tasked with executing the primary duty of the administration of enforcing the law."

Performance in Office

The attorney general commended her tenure and noted that while she was in charge, the Newark saw a significant drop in offenses. She also stated that the southern city of Camden recorded its first summer in half a century without a homicide.

Habba, first joined Donald Trump's lawyers in 2021. She later represented Trump in his business records case in New York last year, which resulted in his conviction on 34 counts of document fraud.
