The NBA legend Tells Court He ‘Wasn’t Afraid’ of the Racing Body in Legal Battle
The basketball icon, as he cordially introduced himself in a Charlotte court on Friday, stated that his competitive side and novelty within the sport motivated his push for 23XI Racing to confront Nascar over perceived violations of antitrust rules.
Financial Stakes and a Competitive Drive
Jordan shared operational insights of his 23XI team, saying he put in $40m of his own funds into the Cup Series operation launched with partner Polk and driver Hamlin.
“It fell to someone to act,” Jordan said during testimony. “As a newcomer, I wasn’t afraid. I felt I could challenge Nascar in its entirety. From my perspective, the sport required examination through a new lens.”
Central Issue: Franchise System and Renewal Demands
At issue is the expiration of a 2016 agreement where Nascar granted each team a franchise. The concept is similar to other professional sports with independent franchises, like the NBA’s Hornets or the Carolina Panthers. The agreement was set to expire in 2024 when Nascar insisted on teams renew their charters.
Jordan was on the witness stand for about sixty minutes and exited the courthouse to pandemonium, with onlookers and reporters vying for a glimpse or a photo of the global icon.
Leading the Legal Charge
Jordan’s 23XI is at the forefront of the push along with Front Row Motorsports for Nascar to overhaul a operating model Jordan said is breaking the law to maintain excessive control.
For Jordan and and Heather Gibbs, who testified before Jordan, are events from September 2024. She recounted a frantic and emotional period where the sanctioning body informed teams they must sign a contract extension. This agreement spanned 112 pages detailing team compensation and a guaranteed entry in Nascar-sponsored races.
A Refusal to Sign
Jordan explained that his team and its ally concluded their only feasible option was to decline to sign that 112-page package and take the issue to court. The other 13 organizations signed the agreement.
The team owners approached Nascar about potential amendments or negotiations. Nascar wasn’t talking, Jordan said.

Ultimately, the resistance against what he saw as a unsustainable system was driven by the familiar goal for Jordan: Success.
“Hamlin persuaded me adding a third car improved our chances to win,” he testified, noting that he bought a third charter last year for $28 million amid the legal dispute. “So I took the plunge.”

Heather Gibbs detailed her request for permanent charters, which she said a formal letter to Nascar. She said the pressure of the signature deadline was problematic.
According to her, the team founder first tried to call and persuade Nascar against demanding signatures, but Nascar’s leader declined the request.
“Please don’t force this on us,” Gibbs recounted Joe Gibbs told Nascar’s executives. She said France replied, “If I wake up and I have 20 charters, that’s what I have. If there are 30, I have 30.”
